1. Acceptance of Terms

By accessing or using FairMedBill ("Service," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

We may update these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

FairMedBill provides an AI-powered medical bill analysis tool that:

• Accepts uploaded medical bill documents (PDF, JPG, PNG, WebP) or manually entered line items
• Uses AI to extract, parse, and flag potential errors, duplicate charges, or suspicious line items
• Returns an analysis report summarizing billed amounts, flagged items, and general observations

3. Not Medical or Legal Advice

Nothing in this Service constitutes:

• Medical advice — we do not interpret diagnoses, treatment plans, or clinical information
• Legal advice — we do not advise on your legal rights, billing disputes, or litigation
• Financial advice — any savings estimates are illustrative and not guaranteed
• Professional medical billing advocacy — our AI is not a licensed billing advocate

For complex billing disputes, please consult a certified patient advocate (BCPA), a medical billing advocate, or a healthcare attorney.

4. User Responsibilities

By using the Service, you agree to:

• Only upload bills and documents you have the legal right to share
• Not upload documents containing other people's protected health information without their consent
• Not attempt to reverse-engineer, scrape, or abuse the Service
• Not use the Service for any unlawful purpose
• Verify any AI-generated analysis before relying on it for billing disputes

5. AI Accuracy and Limitations

Our AI model can make mistakes. Specifically:

• OCR and text extraction from images may be imperfect — blurry or low-resolution documents reduce accuracy
• CPT code matching is based on pattern recognition, not a certified billing codebook
• Flagged items represent potential issues, not confirmed errors — some flags may be false positives
• The AI does not have access to your insurer's contract rates, so savings estimates are approximate

Always cross-reference our analysis with the Explanation of Benefits (EOB) from your insurer and verify with your provider's billing department.

6. Intellectual Property

The FairMedBill application, including its design, code, and AI systems, is our intellectual property. You retain ownership of any documents you upload.

By uploading a document, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the analysis service to you.

7. Limitation of Liability

To the maximum extent permitted by law:

• FairMedBill is provided "as is" without warranties of any kind
• We are not liable for any decisions you make based on our analysis
• Our total liability for any claim arising from use of the Service is limited to $0 (the service is free)
• We are not liable for indirect, incidental, consequential, or punitive damages

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

We reserve the right to suspend or terminate access to the Service at any time, for any reason, without notice. Provisions that by their nature should survive termination (including Sections 3, 6, 7) will do so.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in binding arbitration on an individual basis — not as a class action.
